These Terms of Service ("Terms") govern your use of the Textbo messaging platform operated at textbo.io. By using Textbo, you agree to these Terms.
1. Service Description
Textbo is an SMS messaging platform that enables fixed base operators (FBOs) to communicate with pilots via text message. FBO operators use the Textbo web dashboard to send messages, which are delivered as SMS to pilots' mobile phones. Pilots reply via standard SMS.
2. Eligibility
The Textbo dashboard is intended for use by authorized FBO personnel. Pilot SMS recipients must be 18 years of age or older and must consent to receiving messages before any SMS is sent.
3. SMS Messaging Terms
The following terms apply to SMS messaging through Textbo:
- Consent: Pilots must provide explicit consent to receive SMS messages before being added to the system. Consent is obtained when the pilot provides their phone number and agrees to receive text messages from the FBO via Textbo.
- Message Content: Messages sent through Textbo are operational in nature, relating to aircraft services, fuel, ground handling, departure coordination, and other FBO services.
- Message Frequency: Message frequency varies based on the pilot's interaction with the FBO. Typically, pilots receive messages only during their visit to the FBO facility.
- Opt-Out: Pilots can opt out of receiving messages at any time by replying STOP to any message. Once opted out, no further messages will be sent unless the pilot re-consents.
- Help: Pilots can reply HELP to any message for assistance, or contact admin@textbo.io.
- Costs: Message and data rates may apply. Textbo does not charge pilots for receiving messages, but standard carrier rates may apply.
- Carriers: Supported carriers include major US and Canadian carriers. Carriers are not liable for delayed or undelivered messages.
4. User Responsibilities
FBO operators using Textbo agree to:
- Only add pilots who have provided consent to receive SMS messages.
- Use the service only for legitimate FBO-to-pilot communication related to aircraft services.
- Not send spam, marketing, or promotional content through the platform.
- Maintain the confidentiality of their account credentials.
- Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
5. Prohibited Uses
You may not use Textbo to:
- Send unsolicited messages or spam.
- Send messages to individuals who have not consented to receive them.
- Transmit illegal, threatening, harassing, or abusive content.
- Attempt to gain unauthorized access to the platform or its infrastructure.
6. Privacy
Your use of Textbo is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
7. Disclaimers
Textbo is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. SMS message delivery depends on mobile carriers and network conditions beyond our control. Textbo is a communication tool and should not be relied upon as the sole means of critical communication.
8. Limitation of Liability
To the fullest extent permitted by law, Textbo shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to undelivered or delayed messages.
9. Termination
We reserve the right to suspend or terminate access to Textbo at any time for violation of these Terms or for any other reason at our discretion.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms.
